Access to information: Microsoft forced to show its hand

As a general rule, the price structure of a service, the breakdown of costs, the unit costs and product quantities cannot be disclosed pursuant to an access-to-information request. However, in a recent decision, the Commission d’accès à l’information, Quebec’s access-to-information commission, made an important clarification regarding the confidentiality of such information by allowing Savoir Faire Linux to have access to a strategic and material portion of a contract between Microsoft and the Centre de services partagés du Québec (CSPQ), a provincial government entity that facilitates the procurement of services by public entities.

Christmas parties: the obligations of employers and employees

What exactly is “industrial production”?

In Québec, the Act respecting Municipal Taxation (the « Act ») provides that the machines, apparatus and their accessories used or intended to be used for purposes of industrial production or for purposes of pollution control that may result from industrial production are not to be entered on the assessment roll: thus, are not subject to municipal and school real estate taxes. The same principle applies to the mechanical and electrical systems when they are mainly used or intended to be used for the purposes of industrial production.
