Michel Lebeuf represents Agence Québec Plus in a major M&A transaction
On August 20, athletic footwear and apparel giant ASICS America announced the acquisition of its North American distributor Agence Québec Plus (AQP), based in Sherbrooke, Quebec. The amount of the transaction was not disclosed.
AQP will become an ASICS subsidiary on August 31. The current chief executive of AQP, Denis Custeau, will continue in that position, and the internal structure of the company will remain unchanged. AQP's annual sales are on the order of US$48 million. Michel Lebeuf, a partner in the Montréal office of Langlois Kronström  Desjardins, acted for AQP in this matter.

Tina Hobday appointed Vice President of the McGill Alumni Association
At the McGill Alumni Association Annual General Meeting on Tuesday, May 18, 2010, Tina Hobday, a partner in the litigation group of the Montreal office of Langlois Kronström Desjardins, was elected Vice President of the McGill Alumni Association for a two-year term. Arrival of Anne Caron, Project Manager – Knowledge Management
Langlois Kronström Desjardins is pleased to welcome lawyer Anne Caron to the firm as Project Manager – Knowledge Management. Her mandate will be to implement a system, procedures and policies for knowledge management, knowledge sharing and quality control. Tina Hobday and Paule Veilleux appointed to the Committee on Discipline of the Quebec Bar
On October 15, 2009, the Quebec Bar's General Council appointed Tina Hobday and Paule Veilleux, partners at Langlois Kronström Desjardins, as members of the Committee on Discipline of the Quebec Bar. The Committee on Discipline is composed of three individuals: the Chair - a lawyer appointed by the Quebec government - and two other lawyers appointed by the Quebec Bar.  It is an independent administrative tribunal that hears all complaints filed against lawyers pursuant to the Professional Code, in order to protect the public.

Gasoline price-fixing cartel: class action
Langlois Kronström Desjardins has succeeded in dismissing a motion for permission to institute a class action against its client Canadian Tire Corporation Limited ("Canadian Tire") which was alleged to be a member of a cartel that fixed the price of gasoline in the cities of Victoriaville, Sherbrooke, Magog and Thetford Mines. Quebec Superior Court Justice Dominique Bélanger did however allow the class action to proceed against several other of the named defendants. Essentially it was alleged that all of the defendants colluded to raise the price of gasoline simultaneously in the four municipalities concerned.

Supreme Court Victory for Langlois Kronström Desjardins
Lawyers Reynald Auger and Jean Patrick Dallaire of Langlois Kronström Desjardins, representing both the Caisse Populaire Desjardins de Montmagny and bankruptcy-trustee firm Raymond Chabot Inc., have won an important case before the Supreme Court of Canada in the matter of Quebec (Revenue) v. Caisse populaire Desjardins de Montmagny, 2009 SCC 49.

Quebecor v. Vallières: Langlois Kronström Desjardins has Sun Media's application dismissed

On November 3, 2009, Sun Media Corporation filed legal proceedings against Mr. Yvon Vallières in his capacity as President of Quebec's National Assembly, contesting his refusal to give media accreditation to two journalists seeking to cover proceedings in the National Assembly. According to the President, his decision was necessary to ensure that the business of the legislature be conducted in an orderly fashion. Sun Media is contesting the President's decision and on November 4th sought an interim order that the journalists be accredited pending final judgment in the matter. On November 9, 2009 the Honourable Étienne Parent dismissed Sun Media's application for a safeguard order.

Five Langlois Kronström Desjardins attorneys named to Bar of Montréal committees

At its meeting on May 23, 2009, the Council of the Bar of Montréal appointed its committee members for fiscal 2009–2010. A number of Langlois Kronström Desjardins attorneys will sit on the Bar’s various committees.

$15 Million Claim against Concordia University Dismissed

Langlois Kronström Desjardins recently successfully defended Concordia University in a $15 million action in damages launched against it by a former student who was expelled from the University for academic misconduct.

Marie Cossette comments on Oliphant Commission in the media

The expertise of the Langlois Kronström Desjardins firm in matters of public inquiries is once again being sought—this time by the media—to comment on and explain the proceedings of the Schreiber-Mulroney Commission. Marie Cossette, an attorney from our Montréal office and a former solicitor for the Gomery Commission, the Johnson Commission, and the Poitras Commission, has been asked to appear on RDI and Radio-Canada in order to shed light on this complex affair.

Public hearings for the Oliphant Commission began March 30 in Ottawa and will end in late May. Judge Jeffrey Oliphant has until December 31 to submit his report to the government.

 

Maritime Law team tackles big purchase and financing projects

Since December, the maritime law professionals at Langlois Kronström Desjardins have had a hand in five major transactions involving Groupe Desgagnés Inc. The firm put its extensive expertise to work for the purchase (and financing, where applicable) of the RIGEL fleet of three ships as well as the M/V Rosaire A. Desgagnés, the M/V Zélada Desgagnés, the M/V Sedna Desgagnés, and the M/V Bella Desgagnés (the last two transactions are in progress). These transactions involve investments of over C$240 million.

Commission des lésions professionnelles (CLP): An important ruling won by Éric Latulippe

On February 3, Éric Latulippe, partner at Langlois Kronström Desjardins, won an important ruling for his client, Société de coopérative agricole des Appalaches, in front of CLP. Langlois Kronström Desjardins wins an important arbitration case for CN

Langlois Kronström Desjardins recently successfully completed its engaged on behalf of Canadian National in an arbitration matter involving the Agence Métropolitaine de Transport (“AMT”).  After successfully prosecuting a multi-million dollar claim against AMT, Langlois Kronström Desjardins recently had the arbitration award homologated by the Superior Court of Québec.  In so doing, the award became final and fully enforceable.

Supreme Court victory

The Supreme Court of Canada rendered its reasons for judgment on December 19, 2008 for its June 20, 2008 decision approving the proposed $ 51.7 billion privatization of BCE Inc., the largest leveraged buyout in the world. An action was brought by debentureholders issued by Bell Canada (a subsidiary of BCE Inc.), who sought to prevent the court's approval of the transaction on the ground that it would significantly reduce Bell Canada's credit rating, and consequently the trading value of their debentures.

Another brilliant Supreme Court victory
On December 4, 2008, the Supreme Court of Canada upheld a judgment rendered by the Superior Court of Quebec and subsequently affirmed by the Quebec Court of Appeal, ordering Kruger Inc. to pay Malette Syndics et Gestionnaires Inc., in its capacity as the trustee-in-bankruptcy of La Latte des Berges Inc., damages in the amount of $1,250,000 plus interest and costs.

Another brilliant victory for Langlois Kronström Desjardins in class actions

Langlois Kronström Desjardins’ expertise in class actions once again proves itself, in a magnificent way, through their most recent victory won last Friday by Chantal Chatelain, a firm partner. The Court of Appeal maintained the dismissal of a motion for authorization of a class action suit against nine pharmaceutical companies in the array of accusations regarding the claim that generic drug manufacturers have been delivering several rebates, discounts, bonuses and other benefits to Quebec pharmacists in order to favour the sale of their products. In essence, the Court of Appeal decided that the allegations were insufficient to justify a true semblance of right. Notably, the Court of Appeal deems that the proposition regarding the claim that beneficiaries may have undergone a lost is ¨legally untenable¨.
