A major victory for TELUS
We recently acted for a major telecommunications company (TELUS) in injunction proceedings brought by the second-lowest bidder on a tender put out by SigmaSanté (formerly Approvisionnement Montréal) on behalf of six healthcare institutions with a total of 29 locations. The call for tenders was for the installation of an IP telephone system and the upgrading of IT systems. The plaintiff sought an interlocutory injunction to suspend performance of the contract, which had been awarded to our client, the lowest bidder.

Langlois Kronström Desjardins among the top 15 class action firms in Canada
The Financial Post devoted the entire Legal Post section of its December 7 issue to the subject of class actions in Canada. For this occasion, the newspaper conducted a survey of 64 law firms across the country. The survey's questions concerned the number of lawyers within the firm working on class actions, the number of active class action files, and the number of files resolved over the last few years. With 31 active files, Langlois Kronström Desjardins came 13th and thus made the paper's list of Canada's Top 15 Busiest Defence-Side Class Action Firms. Moreover, Langlois Kronström Desjardins is the only exclusively Quebec firm among the top 15.
Tina Hobday is appointed as Co-Chair


Tina Hobday is appointed as Co-Chair of the Advocacy and Government Relations Committee of The National Pensions and Benefits Law Section of the Canadian Bar Association.

The Canadian Bar Association’s National Pensions and Benefits Law Section has appointed Tina Hobday as Co-Chair of the Advocacy and Government Relations Committee for the 2011-2012 term. This Section’s mandate is to promote and undertake research, facilitate the exchange of information and ideas, organize seminars, review developing legislation, standards and policy and promote harmonization, and advocate for reform on pensions and benefits law, standards, and policy, and related matters.

Chantal Chatelain and Vincent de l’Étoile publish an article in the Revue du Barreau du Québec
Chantal Chatelain and Vincent de l’Étoile, respectively a partner and an associate in the Montréal office of Langlois Kronström Desjardins, have just published an article in Volume 70 of the Revue du Barreau du Québec, entitled L’injonction collective : le recours collectif et l’injonction, un mariage heureux?  [Class injunctions: class actions and injunctions – a happy marriage?]. The article provides a brief overview of the state of the law and the judicial analysis in the decided cases regarding the possibility of bringing a "class injunction".

Major victory in an aboriginal taxation case before the Supreme Court of Canada

On July 22nd, the Supreme Court of Canada handed down its decision in the matter of Estate of Rolland Bastien v. Her Majesty the Queen.

The country’s highest court overturned the decision of the Federal Court of Appeal confirming the decision of the Tax Court of Canada, and declared that the interest income received by the late Rolland Bastien from a term deposit at a branch of the Caisse populaire Desjardins located on the Wendake reserve near Québec City was exempt from tax under section 87 of the Indian Act.

Tina Hobday is elected to the Executive Committee of The National Pensions and Benefits Law Section of the Canadian Bar

The Canadian Bar Association’s National Pensions and Benefits Law Section has chosen its Executive Committee for the 2011-2012 term.  Tina Hobday has been elected as an Executive Member of the Section, which promotes and undertakes research, facilitates the exchange of information and ideas, organizes seminars, reviews developing legislation, standards and policy and promotes harmonization, and advocates for reform on pensions and benefits law, standards, and policy, and related matters.

 

Honorary Consul of Finland
The mandate of Mtre Henri Grondin, senior counsel at law firm Langlois Kronström Desjardins, as Honorary Consul of Finland has been renewed for three years, despite the age limit applicable to the position, at the request of the Republic of Finland.  Mtre Grondin, who specializes in labour & administrative law and aboriginal law, has held the honorary consul position since 1987. He has also received many decorations throughout his distinguished career, including that of Knight of the National Order of Québec (Chevalier de l’Ordre national du Québec), Officer of France’s National Order of Merit (Officier de l’Ordre national du Mérite) and of Finland’s Order of the White Rose, and Knight of the National Order of Burkina Faso (Chevalier de l’Ordre national du Burkina Faso).

An important victory for Metro Inc. in an oppression-remedy lawsuit

Metro Inc., represented by law firm Langlois Kronström Desjardins, has won an important victory in a legal dispute with some of its shareholder merchants. On May 17, 2011, the Honourable Robert Mongeon of the Superior Court of Québec, in a detailed judgment, dismissed the oppression-remedy proceedings claiming abuse of shareholder rights brought by the Regroupement des marchands actionnaires.

Pierre Galardo, new chairman of the board
Pierre Galardo, a partner who practices public and real estate law at Langlois Kronström Desjardins, has been named chairman of the firm's board of directors. He replaces Richard Ramsay, who has been chairman since March 2007. Mr. Galardo has sat on the board for a number of years, and his management experience and thorough understanding of the priorities of the firm will serve him well as chairman. This nomination is supplementary to the recent nomination of three of the firm's younger partners, Tina Hobday, Dimitri Maniatis and Jean-François De Rico, to the board of directors, and to the appointment of Chantal Chatelain as partner in charge of the Montréal office.
Louise Boutin voted president-elect of CREW
Louise Boutin, a partner in the Montréal office of Langlois Kronström Desjardins, has been voted president-elect of the Commercial Real Estate Women (CREW) Network for the next three years (president-elect in 2011, president in 2012, and outgoing president in 2013). The Montreal chapter of the CREW network was founded in 2003 and comprises some 160 women professionals working in all areas of commercial real estate. Its mission is to promote the success of women in the real estate sector. The international CREW network has 73 chapters, five of which are in Canada, and over 80,000 members in North America. Louise has been a member of CREW since 2005 and was its secretary for the past year.
Quebec Superior Court Victory

On January 12, 2011, Langlois Kronström Desjardins was successful in an important and complex case brought before the Superior Court of Quebec. Our firm represented the Defendants in this matter involving a dispute between shareholders of a family holding company. The amount at stake in this matter largely exceeded one hundred million dollars. The Court upheld substantially all of the arguments put forward by Langlois Kronström Desjardins, thereby namely dismissing the Plaintiffs’ action for the transfer of assets by way of permanent injunction and for damages.

On October 18, William Hart, partner in the Montréal office of Langlois Kronström Desjardins, organized a forum in Paris on “Montréal and International Finance” for his client, the International Financial Centre – Montréal (IFC Montréal) in collaboration with the Canadian Embassy in Paris, the France-Canada Chamber of Commerce and the networks of two French “grandes écoles”, Essec and the Ecole centrale.  Langlois Kronström Desjardins was the only law firm involved in this initiative.

Tina Hobday reappointed to the Committee on Discipline of the Quebec Bar
On September 23, 2010, the Quebec Bar's General Council reappointed Tina Hobday as a member of the Committee on Discipline of the Quebec Bar for a three-year term. The Committee on Discipline is composed of three individuals: the Chair - a lawyer appointed by the Quebec government - and two other lawyers appointed by the Quebec Bar.  It is an independent administrative tribunal that hears all complaints filed against lawyers pursuant to the Professional Code, in order to protect the public.

Quebec Superior Court Victory
On September 27, 2010, in the matter of Yves Gougoux et al. v. Alain Richard (S.C. No 500-17-036017-070) the Quebec Superior Court granted a motion to have a litigant declared quarrelsome. Raynold Langlois, Chantal Chatelain and Fabrice Vil successfully represented the applicants, who were being subjected to abusive and vexatious legal proceedings. The judgment is of particular interest for clients, as a declaration of this kind circumscribes, with a view to preventing abuses, the right of an individual to bring legal proceedings.

Gasoline price-fixing cartel: class action
Langlois Kronström Desjardins has succeeded in dismissing a motion for permission to institute a class action against its client Canadian Tire Corporation Limited ("Canadian Tire") which was alleged to be a member of a cartel that fixed the price of gasoline in the cities of Victoriaville, Sherbrooke, Magog and Thetford Mines. Quebec Superior Court Justice Dominique Bélanger did however allow the class action to proceed against several other of the named defendants. Essentially it was alleged that all of the defendants colluded to raise the price of gasoline simultaneously in the four municipalities concerned.

Quebecor v. Vallières: Langlois Kronström Desjardins has Sun Media's application dismissed

On November 3, 2009, Sun Media Corporation filed legal proceedings against Mr. Yvon Vallières in his capacity as President of Quebec's National Assembly, contesting his refusal to give media accreditation to two journalists seeking to cover proceedings in the National Assembly. According to the President, his decision was necessary to ensure that the business of the legislature be conducted in an orderly fashion. Sun Media is contesting the President's decision and on November 4th sought an interim order that the journalists be accredited pending final judgment in the matter. On November 9, 2009 the Honourable Étienne Parent dismissed Sun Media's application for a safeguard order.

$15 Million Claim against Concordia University Dismissed

Maritime Law team tackles big purchase and financing projects

Since December, the maritime law professionals at Langlois Kronström Desjardins have had a hand in five major transactions involving Groupe Desgagnés Inc. The firm put its extensive expertise to work for the purchase (and financing, where applicable) of the RIGEL fleet of three ships as well as the M/V Rosaire A. Desgagnés, the M/V Zélada Desgagnés, the M/V Sedna Desgagnés, and the M/V Bella Desgagnés (the last two transactions are in progress). These transactions involve investments of over C$240 million.

Commission des lésions professionnelles (CLP): An important ruling won by Éric Latulippe

On February 3, Éric Latulippe, partner at Langlois Kronström Desjardins, won an important ruling for his client, Société de coopérative agricole des Appalaches, in front of CLP. Langlois Kronström Desjardins wins an important arbitration case for CN

Langlois Kronström Desjardins recently successfully completed its engaged on behalf of Canadian National in an arbitration matter involving the Agence Métropolitaine de Transport (“AMT”).  After successfully prosecuting a multi-million dollar claim against AMT, Langlois Kronström Desjardins recently had the arbitration award homologated by the Superior Court of Québec.  In so doing, the award became final and fully enforceable.

Supreme Court victory

The Supreme Court of Canada rendered its reasons for judgment on December 19, 2008 for its June 20, 2008 decision approving the proposed $ 51.7 billion privatization of BCE Inc., the largest leveraged buyout in the world. An action was brought by debentureholders issued by Bell Canada (a subsidiary of BCE Inc.), who sought to prevent the court's approval of the transaction on the ground that it would significantly reduce Bell Canada's credit rating, and consequently the trading value of their debentures.

Another brilliant Supreme Court victory
On December 4, 2008, the Supreme Court of Canada upheld a judgment rendered by the Superior Court of Quebec and subsequently affirmed by the Quebec Court of Appeal, ordering Kruger Inc. to pay Malette Syndics et Gestionnaires Inc., in its capacity as the trustee-in-bankruptcy of La Latte des Berges Inc., damages in the amount of $1,250,000 plus interest and costs.

Another brilliant victory for Langlois Kronström Desjardins in class actions

Langlois Kronström Desjardins’ expertise in class actions once again proves itself, in a magnificent way, through their most recent victory won last Friday by Chantal Chatelain, a firm partner. The Court of Appeal maintained the dismissal of a motion for authorization of a class action suit against nine pharmaceutical companies in the array of accusations regarding the claim that generic drug manufacturers have been delivering several rebates, discounts, bonuses and other benefits to Quebec pharmacists in order to favour the sale of their products. In essence, the Court of Appeal decided that the allegations were insufficient to justify a true semblance of right. Notably, the Court of Appeal deems that the proposition regarding the claim that beneficiaries may have undergone a lost is ¨legally untenable¨.
