The Court of Appeal maintained the dismissal of a motion for authorization of a class action suit against nine pharmaceutical companies in the array of accusations regarding the claim that generic drug manufacturers have been delivering several rebates, discounts, bonuses and other benefits to Quebec pharmacists in order to favour the sale of their products.  In essence, the Court of Appeal decided that the allegations were insufficient to justify a true semblance of right.  Notably, the Court of Appeal deems that the proposition regarding the claim that beneficiaries may have undergone a lost is ¨legally untenable¨. 

This is one of the most important class action suits in Quebec, with damages being requested in amounts exceeding 3.9 billion dollars.

Chantal Chatelain was representing the respondent, RhoxalPharma, now known as Sandoz, in these proceedings.
